Live HDF5 Software License Agreement

This License governs use of the Live HDF5 Toolkit, hereafter refered to as the Library, and your use of the Library constitutes acceptance of this license. Note that the HDF5 library and documentation(hdf5.dll, etc.) distributed with the library are governed under a separate license, appended at the end of this document.

SUMMARY

This license provides free use of the Library, provided that it is not redistributed in any form in a Commercial endeavor. Those interested in commercial redistribution should contact UPVI to discuss licensing options.

DEFINITIONS

Library
The software included with this license agreement and its associated documentation.
Derivative Work
Any modification to the original Library.
Combined Work
Any higher-level application, library, compilation, etc. which incorporates or otherwise utilizes the Library.
Commercial
Any activity intended to generate profit or other material benefit. Examples include developing a product, application, or library for sale; developing a custom product, application, or library (i.e. derivative or Combined Work) under a for-profit contract; licensing, leasing, or selling the Library, derivative work or Combined Work; running business operations; and developing a derivative or Combined Work for research or government use, whether at a public or a private institution.
Non-commercial
Any activity which is primarily private-not-for-profit or educational in nature. Examples include: classroom, use in a private home.
Distribute
to make available to other persons or entities copies of the Library, Combined Work, or derivative work through sale or other transfer of ownership.
You
an individual or entity exercising rights under this License who has not previously violated the terms of this License with respect to the Library, or who has received express permission from the Licensor to exercise rights under this License despite a previous violation.

LICENSE

UPVI, LLC grants you the following rights in perpetuity

  1. You may use this Library for any purpose, commercial or non-commercial, subject to the restrictions in this license. You may incorporate the Library, or portions thereof, into a Combined Work.

  2. You may modify the Library for your use. However, such derivative works may not be distributed in any form.

  3. You may distribute this Library in complete, unmodified form for non-commercial purposes. You may distribute a Combined Work for non-commercial purposes.

    You may NOT distribute this Library, any derivative work or Combined Work in any form for commercial purposes. (Persons interested in commercial distribution should contact UPVI, LLC. to arrange a licensing agreement.)

  4. You may use any information in intangible form that you remember after accessing the Library. However, this right does not grant you a license to any of UPVI's copyrights or patents for anything you might create using such information.

In return, we require that you agree:

  1. Not to remove any copyright or other notices from the Library.

Governing Law and General Provisions: This Agreement shall be governed and construed under the laws in the State of Michigan without regard to its conflicts of law rules. Any suit brought with respect to this Agreement may only be brought in Houghton County, MI or the closest applicable court. If any provision herein is found void or unenforceable, it will not affect the validity of the balance of the Agreement, which shall remain valid and enforceable according to its terms.
